Fresh Connects LLC respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. §512 ("DMCA").

Designated agent

How to report infringement

Send a written notice to the agent that includes:

your physical or electronic signature, or that of the person authorized to act for the copyright owner;
identification of the copyrighted work you say is infringed;
identification of the material on Fresh Connects you want removed, with enough detail for us to find it, such as the seller's name and the product or a link;
your name, address, telephone number and e-mail address;
a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law; and
a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

We may forward your notice, including your contact details, to the user who posted the material.

Counter-notice

If your material was removed and you believe it was a mistake or misidentification, you may send the agent a counter-notice that includes:

your physical or electronic signature;
identification of the removed material and where it appeared before removal;
a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;
your name, address and telephone number; and
a statement that you consent to the jurisdiction of the federal district court for the Southern District of California, or of any district where you are located if outside the U.S., and that you will accept service of process from the person who sent the original notice or that person's agent.

We will forward the counter-notice to the person who sent the original notice. Unless that person tells us within 10 business days that they have filed a court action, we will restore the material within 10 to 14 business days after receiving the counter-notice.

Repeat infringers

We close the accounts of users who infringe repeatedly, in appropriate circumstances.

False claims

Under 17 U.S.C. §512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages, including costs and attorneys' fees.

Trademarks and other complaints

For trademark, false-advertising or other intellectual property complaints that are not copyright, e-mail support@freshconnects.com with the details. We review each complaint under the Acceptable Use Policy.
