Privacy Policy

FRESH CONNECTS LLC, a California limited liability company ("Fresh Connects," "we," "us," or "our"), operates a business-to-business marketplace and communications platform that connects food and supply wholesalers, retail buyers and service providers across the United States. This Privacy Policy explains what information we collect, how we use and share it, how long we keep it, and the rights you have. The Service is for businesses; the personal information we handle is mostly business-contact information about the people who work for our users and their customers.
1. Information We Collect
We collect information you provide directly and information generated by your use of the platform:
- Account information: business name, contact name, e-mail address, phone number, business address, city and state, the type of business, and — for team members and additional locations — the names, logins and contact details the account holder adds.
- Sign-in security: your password (stored only as a hash) and, if you turn on two-factor authentication, the phone number or e-mail address you choose to receive codes at or the fact that an authenticator app is enrolled.
- Transaction data: price lists, products browsed, orders placed and their status, quotes requested, delivery fees and minimums, credit limits and payment records a seller keeps for its customers, and messages exchanged with other marketplace participants.
- Text, WhatsApp and call data: if you use text (SMS), WhatsApp or phone (voice) ordering, the phone number you contact us from, the content of your messages, and — for voice orders — a written transcript of the call produced by automated speech recognition (we do not store audio recordings of calls), so we can process and fulfill your orders.
- Content you upload: price-list files, product photos and promotional videos a seller chooses to publish.
- Assistant and automation data: the questions you type to the in-app assistant, the requests you give the order builder, and the automated responses, kept with your account so we can process them and review errors.
- Usage data: pages visited, features used, search queries, and actions taken within the app — used to improve the platform and to meter usage that is billed to wholesalers (Terms, Section 4).
- Device and technical data: browser type, device type, IP address, error logs, and — if you enable them — the push-notification registration for your browser or device.
- Cookies and local storage: we use browser storage to keep you signed in, remember your preferences, and improve performance. We show a cookie notice on first visit. We do not use advertising cookies or sell data to ad networks.
2. How We Use Your Information
- Operate the marketplace — matching buyers with the sellers that serve their city and state, showing prices and availability, processing orders and quotes, and enabling communication between parties.
- Interpret orders with automated tools — text, WhatsApp, voice and web requests are interpreted by automated systems, including artificial intelligence, to build orders, suggest products, read uploaded price lists and answer questions about the Service. For calls this includes converting your speech to text in real time and keeping the transcript so the order can be processed accurately and the Service improved.
- Bill and meter — count text, WhatsApp and voice usage and subscription periods so the account holder is charged correctly; send statement, payment-reminder and low-balance notices.
- Send transactional communications — order confirmations and status updates, price lists, quote notifications, account approvals and security codes, by e-mail, text, WhatsApp, voice or push notification. Marketing messages go only to customers who have opted in, at a seller's request; you can opt out at any time (reply STOP to a text, or change your notification settings).
- Publish aggregated market statistics — for example a public range of current wholesale prices for a produce item in a market. These statistics are de-identified, are shown only when enough sellers contribute that no single seller can be identified, and never include a seller's or buyer's name.
- Improve the platform — analyzing usage patterns and errors to make Fresh Connects faster, easier and more useful.
- Provide support — diagnosing issues and responding to inquiries. Support staff may view your account in a support mode; those sessions are logged.
- Maintain security — detecting fraud, abuse and unauthorized access, and verifying identity for sensitive actions.
3. How We Share Your Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only in the following circumstances:
- With the marketplace participants you transact with: when you place an order, request a quote or exchange messages, the other party sees the information necessary to fulfill that transaction (for example your business name, contact details, delivery address and order details). A seller can also see which of its customers are "known" to it (a prior accepted order, a credit record or a contact it added) and may limit its prices to known customers.
- Within your own business: team members and location accounts under an account holder see the business's information according to the role the account holder gives them.
- Service providers that process data on our behalf under contracts that restrict their use of it: cloud hosting and database services; e-mail delivery; telecom and messaging providers that deliver text messages, connect, record and transcribe phone ordering calls, and deliver WhatsApp messages (WhatsApp itself is operated by Meta Platforms and subject to its terms); an artificial-intelligence provider that processes message content, call transcripts, order requests and uploaded price lists to generate the automated responses described above and, under our agreement, does not use that data to train its models; and error-monitoring and uptime services.
- Legal requirements: we may disclose information if required by law, court order or governmental request, or to protect the rights, property and safety of Fresh Connects, our users or the public.
- Business transfers: if Fresh Connects is involved in a merger, acquisition, financing or sale of assets, your information may be transferred as part of that transaction, subject to this Policy.
- Mobile information and text-messaging consent: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, or sold to, any third party.
4. Data Retention
We keep information for as long as it is needed for the purposes above, using these criteria:
- Account and business records — for as long as your account is active, and afterwards for as long as needed to complete open orders, resolve disputes and meet legal, tax and accounting obligations.
- Orders, invoices, credit and payment records — retained as business records of both parties to the transaction, including after either account closes, for the period required for tax and accounting purposes.
- Text, WhatsApp and call content and transcripts — retained while needed to process and support the related orders, to review automated-processing errors and to resolve billing questions. We do not currently apply a fixed deletion period to these records; you may request deletion under Section 5.
- Usage, device and error logs — retained for as long as needed for security, diagnostics and billing; no fixed deletion period currently applies.
You may request deletion of your account at any time (Section 5). Records another user needs for its own orders, invoices or receivables are retained for that user.
5. Your Privacy Rights
Depending on where you live, you may have rights over your personal information. We honor the rights below for every user regardless of state, and we respond to verified requests within 45 days.
- Right to know / access: request a summary or copy of the personal information we hold about you and how it has been used or disclosed.
- Right to correct: ask us to correct inaccurate information (most account details can be edited in Settings).
- Right to delete: ask us to delete your personal information, subject to the retention criteria above and legal exceptions.
- Right to opt out of sale or sharing: we do not sell personal information or share it for targeted advertising, so there is nothing to opt out of.
- Right to limit use of sensitive information: we use sensitive information (such as account credentials and phone numbers used for security codes) only to provide the Service.
- Right to non-discrimination: we will not discriminate against you for exercising your privacy rights.
California residents have these rights under the California Consumer Privacy Act (CCPA/CPRA). Residents of other states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, Texas and Oregon) may exercise the rights those laws grant in the same way. To exercise any right, e-mail support@freshconnects.com from the e-mail address on your account, or have an authorized agent do so with proof of authority; we will verify the request before acting. If we decline a request you may ask us to reconsider.
6. Security
We use industry-standard security practices including encrypted connections (HTTPS), hashed passwords, token-based authentication, rate limiting, optional two-factor authentication for every account (authenticator app, e-mail code or text code) and required two-factor authentication for administrators. No system is completely secure; please use a strong, unique password and turn on two-factor authentication.
7. Children's Privacy
Fresh Connects is a B2B platform intended for business use only. We do not knowingly collect information from individuals under 18 years of age.
8. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will update the effective date at the top of this page; for material changes we will notify users by e-mail or an in-app notice and may ask you to accept the updated Terms of Service and Privacy Policy before you continue.
